Our general conditions of sale:
(1) Generality:
The present general conditions of sale apply between:
S.A.R.L Ouikos in the capital of 8 000 euro SIRET: 531 875 201 00026 APE: 6312Z - RCS ANGOULÊME: 531 875 201, whose headquarters is located 9 road to schools - 16720 ST - even careers and any physical person making a purchase via the website www.ouikos.com.
These conditions aim to define the terms of distance selling and selling online, the order for payment and delivery.
The surfer said: do not make purchases of products and brand Ouikos for resale.
All purchases made through the site ouikos.com implies a complete adherence to these terms and conditions. The validation of the order confirms acceptance of these terms and conditions by the client.
The data recorded on the ouikos.com site are the evidence of all of the elements of the order placed by the client (identity, address of delivery and billing, references products, quantities, modes of regulation... indicative and non-exhaustive list).
(2) Subject:
These terms and conditions relate to the sale of goods and the provision of services by ouikos to one of its customers, through a mail order system.
(3) Products:
3.1 The products sold on Ouikos.com are textile products and/or objects that are made (or not) from marking of our workshop with participation (or not) of the client.
3.2 Under article l. 111 - 1 of the Code of consumption, the presentation of the products offered on the ouikos.com website allows the client to know the essential characteristics of the product he wants to order.
3.3 Ouikos.com describes and displays the products for sale on the website with more possible details (details of model, composition and size). In no case the responsibility of Ouikos will not be committed due to any changes or errors in the description of the characteristics of the purchased product. The validity of the sale will not be affected. The photographs are not contractual and texts illustrating the products are only indicative and do not enter the contractual field.
3.4 All creations sold on the site ouikos.com are protected, any reproduction is prohibited.
3.5 The client who wishes to reproduce a document on a t-shirt (for example a photo or a logo), said all legal rights documents. The responsibility of Ouikos will not be liable where the author of a document, or his heirs, assigns, or corporations of perception, agents of the author or the heirs or having the same rights would come to claim compensation. In this case, only the responsibility of the client to Ouikos would be committed.
Ouikos reserves the right to refuse any order him seemed contrary to the texts and laws in force in France.
3.6 All the products of a "Ouikos" creation at the effigy of a team and/or a structure are offered for free sale unless otherwise said team and/or structure.
(4) Price:
The awards are presented in euros (TTC) including VAT excluding delivery charges which remain the responsibility of the user, and 19.60% reference or specific conditions.
All prices include the VAT applicable on the day of the order. If the rate were to be modified, these changes could be passed on the price of the articles without the user being previously informed.
Ouikos reserves the right to modify its prices at any time. Products will be invoiced on the basis of the rates in effect when the order record.
Any command is express and irrevocable acceptance of prices and descriptions of products available for sale.
Shipping costs are charged and justified separately on the invoice.
The client must pay the shipping costs, which can depend on the value of the command and the place of delivery.
(5) Manufacturing delays:
5.1 In flexography, usual time 7 days out weekend and public holiday.
5.2 In full Sublimation, usual time within 4-5 weeks. Swimwear reassorts commands are taken into account for the following Monday. (Production suspended for the first two weeks of July)
(6) Shipment:
6.1 The expedition is usually under 24 / 48 h out of weekend and after manufacturing for customization.
6.2 Deliveries are carried out within a time between 0 and 2 days (in France Metropolitan) depending on the type of carrier chosen by the customer. This delivery time is effective after acceptance of the payment. In any event, the delivery time could not exceed 30 days from the confirmation of the order by e-mail to the customer. Overflow of the date limit of delivery by more than 15 (fifteen) days, the customer may cancel his order by simple mail via the contact link.
6.3 The delivery time is applicable provided that all of the products in stock and that the realization of the command does not require special treatment (ground to rework, complicated to achieve). In the case of a failure, the client will be notified by e-mail that his command is not feasible in these times.
No refund of postage will be requested if the estimated delivery date is exceeded.
6.4 Deliveries are performed by independent carriers of ouikos.com to the address of delivery indicated by the customer.
Carrier:
-Colissimo with follow-up/recommended: the package is delivered to his home by his factor. Absence, the purchaser or the recipient of the ordered product receives a notice of
passage of its factor, allowing it to withdraw the products ordered at the nearest post office, within a period of fifteen days. The package is considered as delivered follow-up instructions.
-Colissimo with suivi: the package is delivered to his home by his factor. The package is filed without signing in the mailbox of the recipient. Absence, the purchaser or the recipient of the ordered product receives notice of passage of its factor, allowing it to withdraw the products ordered at the nearest post office, within a period of fifteen days. The collis is considered as delivered follow-up instructions.
-Inbox: The package is delivered to his home by his factor. The package is filed without signature and follow-up in the mailbox of the recipient. Valid for a package of 2 cm in maximum thickness. Make sure that your box letter is able to contain the package. The package is considered delivered 48 hours after shipment. No claim will be possible in case of loss or theft during transport.
6.5 All products are deposited in the customer to the delivery address indicated in the order.
(7) Error of delivery and/or non-compliance:
7.1 The products travel under the responsibility of ouikos to the carrier. It belongs to the customer upon receipt of the product to verify the contents and the State and to issue any reserve or claims which would appear justified (damage, product missing from the good of delivery, parcel damaged, damaged products, marking error, error of color, omission...).
7.2 Any claim will have to be imperatively indicated on the bon de livraison form handwritten reserves, accompanied by the signature of the client. Any claim formulated beyond this deadline will be rejected. For accepted claims, the customer will be proposed a new shipment of the order.
7.3 If the products delivered do not conform in nature or quality to the indications mentioned in the order confirmation email sent to the customer by ouikos, the customer must formulate its claims in 2 (two) working days following the delivery date. Any claim formulated beyond this deadline will be rejected. This claim will be made by e-mail here or by postal mail at the following address:

In all cases, the client must specify the invoice number, the number of slip delivery, references and quantities of the products ordered and any products delivered by mistake (references and quantities). In case of error or problem of delivery, the customer will be proposed an Exchange.
7.4 Any product exchange or refund must be returned to ouikos in perfect condition, the returned item must be not worn, not washed, with all of the labels, in its original packaging, in Colissimo recommended, to the following address:
To be accepted, any return will have to be reported to the ouikos customer service. Where the error is, the costs of return are borne by ouikos. They are made by the client and reimbursed on presentation of an invoice mentioning the fresh said of expedition.
7.5 On the products in custom with design full sublimation, the junctions of design on the seams are not guaranteed and may be the subject of a claim.
(8) Availability/supplies:
8.1 The products are offered for sale within the limit of available stocks and opportunities for procurement suppliers Ouikos. The availability of products will be validated in the preparation of the command.
8.2 Breakdown of stock or unable to supply within a maximum period of 30 (thirty) days, it will be proposed to the customer refer on another product or to cancel his order. These potential absences are completely beyond our control, the responsibility of ouikos will not be committed to.
8.3 Ouikos will not be held liable for any delay or failure to deliver due to rupture of stock, a delay or a failure to supply by its supplier, to a case of force majeure, a strike at its supplier, its carrier, intermediate or its personnel, or in case of disruption of postal, transportation services, communications, or flood, fire or any other cause involuntary.
(9) Protection of personal data:
9.1 Order on the ouikos.com site, we ask you to open an account. A number of information is requested. This account is protected by a password. Ouikos does not have access to this password and will not be the
provide by telephone. In case of loss, use the "Forgot your password" link, a new password will be sent to you by mail.
9.2 The customer data collected on this site we are designed. In accordance with the law Informatique et Libertés, the treatment of nominative information to clients of the company Ouikos was the subject of a declaration to the National Commission for computing and liberties (CNIL). Pursuant to Act No. 78-17 of 6 January 1978 relating to computing, files and liberties, any person has a right of access, rectification and opposition to the personal data. (10) Payment:
Ouikos offers a number of means of payment. The products are payable with the command.

(11) Right of withdrawal, refund:
11.1 Article L120-20, the consumer has a period of 7 (seven) days from the date of receipt of the order to withdraw. In this case it should return the product ordered in perfect condition, not, not washed, in his packing of origin at the following address:

Only non-specific custom products by the customer are concerned by this article, in accordance with the article L 121-20-1 of the consumer code. The customization means by adding personal text and/or images, but also the use of reasons proposed by Ouikos on articles. The refund will be only on nonconformities cited in section 7.3.

1.2 The client wishing to return product must previously inform the ouikos.com customer service within a period of 7 (seven) days from the date of receipt of the order by e-mail here. Receipt of the withdrawal request, the ouikos.com Client service will assign a return for the product number and forward it to the client by e-mail or by phone. The client then has 7 (seven) days to return the product. Any product returned without the return number will not be refunded to the client.
11.3 Any delivery interrupted, due to the client for a few cases that it either does rise to no reimbursement of the deposit paid for the cost of studies and creation.
11.4 The customer will receive the full refund of the price paid for the products returned (Paypal, service costs and costs of delivery or manufacturing). This refund will be sent to him within a maximum period of 30 (thirty) days from the receipt of the products in question and after verification of their State. The costs of return will be borne by the client. Products shipped for refund or owed port will be refused.
(12) Intellectual property:
12.1 the elements making up the site are protected by the intellectual property code. Any reproduction is prohibited without prior express permission. Any use in other conditions is constitutive of the crime of infringement provided for and punishable under the provisions of the code of intellectual property.
12.2 All worked or reworked files are not distributed and remains the property of Ouikos.
12.3 Ouikos reserves the right to display all models or designs from a command.
(13) Responsibility:
Our responsibility will not be liable for consequential damages, nor for loss of all kinds (financial, commercial, image, data, information,...) resulting from the use or impossibility total or partial to use the product.
(14) Law, and litigation:
The parties agree that the contract is subject to the French right. The language of this contract is the French. In the hypothesis where a dispute is born, the user and ouikos commit before any judicial action to seek a friendly solution. Disputes will be the jurisdiction of the French courts.
These terms and conditions are editable at any time without notice.
