These general conditions of sale apply between:

These conditions aim to define the terms of distance selling and selling online, in order to make payment and delivery.
The Internet says: purchases of products and use of the Ouikos brand for resale are prohibited.
All purchases made through the website ouikos.com imply full acceptance of these conditions. The validation of the order confirms the full acceptance of these conditions by the client.
The data recorded on the site ouikos.com constitute proof of all elements of the order placed by the customer (identity, shipping address and billing references of the products, quantities, payment methods ... Tentative List not exhaustive).
These conditions concern the sale of goods and provision of services by ouikos to one of its clients, as part of a mail system.
3.1 The products sold on Ouikos.com are textile products and / or objects that are made (or not)under the markings from our creative workshop with the participation (or not) of the client.
3.2 In accordance with Article L. 111-1 of the Consumer Code, the presentation of products offered on the site ouikos.com allows the customer to know the essential characteristics of the product they wish to order.
3.3 Ouikos.com describes and presents the products for sale on the site with as many details as possible (model detail, composition and size) Sizes tables. In no event shall Ouikost be held responsible due to any changes or errors in the description of the characteristics of the product purchased. The validity of the sale will not be affected. Photographs are not contractual and texts illustrating the products are indicative only and are not included in the contract.
3.4 All creations sold by ouikos.com on the site are protected, any reproduction is prohibited.
3.5 The customer who wishes to reproduce a document on a tee (eg a photo or a logo), shall obtain and hold all legal documents for such use or reproduction. Ouikos shall in no event be held responsible or liable if the author of a document, or his heirs, assigns, or collecting societies, agents of the author or heirs or assigns of such in the event of a claim for compensation. In this case, only the customer's responsibility to Ouikos would be engaged.
Ouikos reserves the right to refuse any order contrary to the texts and laws in France.
3.6 All products of creation "Ouikos" with the image of a team and / or structure are offered for sale unless otherwise free of that team and / or structure.
3.7 Caution our logo is always present at the bottom of each jersey ensuring the quality and provenance.
The price are presented in euros (TTC) including 20% VAT and excluding delivery costs, which are borne by the user, unless otherwise stated or under special conditions.
The prices include the VAT at the date of the order. If the rate is altered, these changes could be reflected in the price of items without the user being notified.
Ouikos reserves the right to change prices at any time. The products will be billed based on rates in effect at the time of registration of the order.
Any order expresses irrevocable acceptance of prices and descriptions of products available for sale.
Shipping charges are billed separately and shown separately on the invoice.
The customer has to pay shipping costs, which may depend on the value of the order and the delivery location.
5) Production time:
5.1 On Personalized/custom orders, the usual delay is 4-6 weeks. Orders for restocking jerseys are considered the following Wednesday. (Production suspended for the end of year holidays)
5.2 For any order or pre-order custom jersey, the manufacturing time is clearly stated and the order cannot be canceled, changed or refunded.
6.1 Shipping is usually within 24/48 hours excluding weekends away and after manufacture for customization.
6.2 Deliveries are made in an estimated period of 48 hours (in France) according to the type of carrier chosen by the customer. The delivery time is from after the acceptance of payment. In any event, the delivery time cannot exceed 30 days from the order confirmation email to the customer. In case of exceeding the deadline for delivery of more than 15 (fifteen) days, the customer may cancel the order by simple email via the contact link.
6.3 The delivery period is applicable provided that all products are in stock and that the fulfillment of the order does not require special treatment (pattern rework, complicated printing etc.). In the case of inability to fulfill the order, the customer will be notified by email that the order is not feasible at this time.
Postage will not be refunded whether or not the estimated delivery date is exceeded.
6.4 Ouikos.com deliveries are made by independent carriers to the shipping address provided by the customer.
-Colissimo With tracking / recommended: The package is delivered to the buyer’s or recipient’s home by the postman against signature. In case of absence, the buyer or recipient of the item receives a notice from the postman, allowing withdrawal of the products from the nearest post office within FIFTEEN DAYS. The package is considered delivered according to the tracking information.
-Colissimo With tracking: The package is delivered to the buyer/recipient’s home by the postman. The package is delivered, without signing, in the recipient's mailbox. -Package Prio International (shipments outside France): The package is delivered to the buyer/recipient’s home by the postman. The package is delivered, without signing, in the recipient's mailbox. The package is considered delivered according to the tracking information. (see section 6.6)
6.5 All products are delivered to the customer at the delivery address specified when ordering.
6.6 Any order placed on the site and delivered outside of metropolitan France may be subject to taxes and customs duties which are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are at the customer's expense and are their responsibility. We are not required to check and inform you of customs duties and taxes. Please note that by ordering on the website, you are considered (e) the official importer and are held (e) to comply with all laws and regulations of the country where you will receive the goods. We want our customers to be aware that cross-border deliveries are subject to opening and inspection procedure by the customs authorities.
7) An error of delivery and / or non-compliance:
7.1 The products travel under the responsibility of ouikos and the carrier. It is the customer’s responsibility, upon receipt of goods, to verify the contents and condition and to make any reservations or claims that may appear justified (damage, missing product compared to the delivery order, damaged package, damaged goods, error marking, color error, omission ...).
7.2 Any claim must be indicated on the delivery form of handwritten reserves, accompanied by the signature of the customer. The customer must confirm this claim with Ouikos within 2 (two) business days following the date of delivery by ICI email or by registered mail with return receipt stating such claim to the following address:

Any claims made beyond this time will be rejected. If claim is accepted, the customer will be offered a new shipment of the order.
7.3 If the goods delivered do not conform in kind or in quality to the indications mentioned in the email order confirmation sent to the customer by ouikos, the customer must make claims within 2 (two) business days following the date of shipping. Any claims made beyond this time will be rejected. This claim will be made by email HERE or by mail at the following address:

In all cases, the customer will specify the invoice number, delivery note number, references and quantities of products ordered and any incorrect delivered products (references and quantities). In case of error or delivery problem, the customer will be offered exchange.
7.4 Any product for exchange or refund must be returned to ouikos in perfect condition. The returned item must be unworn, unwashed, with all tags, in its original packaging, and shipped by Colissimo Recommended to the following address:

To be accepted, any return will be reported prior to shipment to Customer Service ouikos. In the case where the error actually occurred, the return costs are borne by ouikos. They are paid by the customer and refunded upon presentation of an invoice for the so-called shipping charges.
7.5 On Personalized products with custom design,the positioning of elements depending on the jersey's size and can vary, design junctions on the seams are not guaranteed and are not be subject to a claim.
7.6 Depending on availability of machines and materials, the colors may vary in case of restocking orders, this will not give rise to a claim.
7.7 There may be a difference in color between the digital and the final product model. In fact, the color rendering varies on each screen. This cannot be the subject of a claim.
8) Availability / provisioning
8.1The products are offered for sale based upon the stocks and procurement opportunities from the suppliers of Ouikos. Product availability will be confirmed during the preparation of the order.
8.2 In case of out of stock or unable to supply within a maximum period of 30 (thirty) days, the customer will be asked to refer to another product or cancel the order. These events of possible unavailability are totally beyond our control, and Ouikos will not be held responsible as a result of these events.
8.3 Ouikos will not be liable for any delay or non-delivery due to out of stock, a delay or a failure to supply by its supplier, with a case of force majeure, a strike at its supplier, its carrier, any intermediary or its personnel, or in case of disruption of postal services, transportation, communications, or in case of flood, fire or other accidental cause.
9) Personal data protection:
9.1 To order ouikos.com on the site, we ask you to open an account. A certain amount of information is requested. This account is protected by a password. Ouikos has no access to this password and cannot provide passwords by telephone. In case of loss, use the link "Forgot your password" a new password will be sent by mail.
9.2 The customer data collected on this site are for us. Under the Data Protection Act, the processing of personal information about customers of the Company Ouikos has been declared to the Commission Nationale Informatique et Libertés (CNIL). Pursuant to Law No. 78-17 of 6 January 1978 relating to data, files and freedoms, everyone has a right of access, rectification and opposition to personal data concerning him. Ouikos proposes a certain number of payment options. Products are payable on order.
Penalties for late payment : in addition to late payment indemnities, any amount that remains unpaid at terms, entails by rights the application of fixed compensation payment of 40 euros , for recovery costs under article (Articles 441-6, I alinéa 12 et D. 441-5 du code de commerce.), and late penalties (monthly rate ) : 12% payable on the day following the settlement date on the invoice. The penalty is based on the amount all taxes included, accruing from the due date of the invoice. This prerogative can be triggered by simply noting the non-payment without the need for prior formal notification.
11) Right of withdrawal refund:
11.1 In accordance with Articles L121-20-12, the consumer has a period of fourteen (14) days from the receipt of the order date for withdrawal. In this case the product should be returned in perfect condition, unworn, unwashed, in its original packaging to the following address:

Only non-specifically customized products by the customer are covered by this article, in accordance with Article L. 121-20-12 of the Consumer Code. Personalization means by adding text and / or personal images, but also the use of patterns proposed by Ouikos on items. The refund will only be made on non-compliance mentioned in section 7.3.
11.2 The Customer wishing to return goods must imperatively first inform the Customer Service ouikos.com within 14 (fourteen) days from the date of receipt of the order, ICI email. Upon receipt of the application for revocation, the Customer Service ouikos.com will assign a return number for the product and forward it to the customer by email or phone. The customer then has 14 (fourteen) days to return the product. No product returned without this RMA number will not be reimbursed.
11.3 Any service enabled, interrupted, shortened because of any action by the client for any reasons whatsoever does not give rise to any refund of the deposit paid for the costs of studies and creation.
11.4 The customer will receive a full refund of the price paid for the products returned (except PayPal fees, services and delivery costs or manufacturing). This refund will be sent to him within a period of 30 (thirty) days from receipt of the products in question and after verification of their condition. Return costs will be borne by the customer. Products shipped against reimbursement or freight collect will be refused.
12) Intellectual property:
12.1 The elements of the website are protected by the code of intellectual property. Reproduction is prohibited without prior permission. Any use in other conditions constitutes expected forgery and is punishable under the provisions of the Code of Intellectual Property.
12.2 All worked or reworked files are not distributed and remain the property of Ouikos.
12.3 Ouikos reserves the right to display all models and / or works from a command.
Our responsibility will not be engaged for consequential damages or for loss of any kind (financial, commercial, image data, information ...) resulting from the use or the total or partial inability to use the product .
14) Applicable law, disputes:
The parties agree that the contract is subject to French law. The language of this contract is French. In the event that a dispute arises, the Internet and ouikos agree before any legal action to seek an amicable solution. Disputes will be the jurisdiction of French courts.
The terms may be changed at any time without notice.
